In order to become a conditional resident, the applicant must file Form I-485, Petition to adjust status after a qualifying marriage with an LPR or a USA citizen.
Once approved, the applicant will be granted a two-year conditional resident status. During this time, the applicant must maintain their residence in the U.S. and comply with all the laws of the country. They must also not leave the country for more than six months during the two-year conditional period.
At the end of the two-year period, the conditional resident must file Form I-751 again to remove the conditions on their status. If the conditions are not removed, the applicant may be deported.
The conditional resident status allows individuals to enjoy the same rights and privileges as a permanent resident, including the ability to work and travel in the U.S. However, it is important to note that conditional residents may not become U.S. citizens until the conditions have been removed.
