October 26, 2023How to obtain a Green Card through a Provisional Waiver
Getting Legal Residency:
If you’ve entered the country unlawfully, there may still be a possibility for you to obtain a green card.
The United States has long been a nation of immigrants, and the pursuit of the American dream continues to attract people from all corners of the world. For those who have entered the country illegally, the path to legal residency may seem particularly challenging. But there is hope.
A potential path open to specific individuals who entered the United States unlawfully, without a visa, and have stayed in the country without proper documentation for more than a year is the Provisional Unlawful Presence Waiver. The provisional waiver has been in effect since March 4, 2013, and it offers a chance for immediate relatives of U.S. citizens, including spouses, children, and parents, to pursue permanent residency while residing in the USA and ultimately obtain a green card.
Understanding the Provisional Unlawful Presence Waiver:
The Provisional Unlawful Presence Waiver is a crucial step for those who entered illegally and wish to fix their immigration status and become lawful residents of the United States.
Eligibility Criteria: As mentioned earlier, this waiver is available to immediate relatives of U.S. citizens. This category includes spouses, children, and parents. To be eligible, the immigrant must also be able to prove extreme hardship to the U.S. citizen family member.
The Application Process:
Immediate Relative Petition: Your first step is to file an immediate relative petition with the United States Citizenship and Immigration Services (USCIS). Once this petition is approved, you’ll move forward in the process.
Form I-601A – The Provisional Unlawful Presence Waiver: After the immediate relative petition is approved, you will need to file Form I-601A, the Provisional Unlawful Presence Waiver and establish extreme hardship to your USA citizen relative.
This critical step is accompanied by submitting supporting documentation that demonstrates the extreme hardship your U.S. citizen family member(s) would face if you were deported or denied entry into the U.S.
USCIS Approval: Once your I-601A waiver is approved by USCIS, you’ll gain the freedom to travel back to your home country.
Overseas Interview and Reentry with Green Card: After the I-601 A waiver is approved, we will prepare the necessary documents to schedule you for an interview overseas. While overseas, you’ll undergo an interview as part of the green card application process. Upon approval, you’ll promptly reenter the United States with your green card in hand, securing your status as a lawful permanent resident.
