October 11, 2023A Guide to Obtaining a Fiancée Visa and Green Card for Your Loved Ones
When you find the person you want to spend the rest of your life with, distance shouldn’t matter. Bringing your loved one to your country can be easier with a fiancée visa if you’re in a cross-border relationship.
What is a Fiancée Visa?
Foreign nationals engaged to U.S. citizens can obtain the fiancée visa, also known as the K-1 visa. Its purpose is to allow the foreign fiancé(e) to enter the country, marry their U.S. citizen partner, and then apply for adjustment of status to become a lawful permanent resident.
The Fiancée Visa Process
Meet Eligibility Requirements:
- You must be a U.S. citizen
- You and your fiancé(e) must have met in person at least once within the two years prior to filing the petition.
- File a Petition: The U.S. citizen must file a Petition for Alien Fiancé(e), with U.S. Citizenship and Immigration Services (USCIS).
USCIS Processing: USCIS will review the petition and, if approved, forward it to the U.S. embassy or consulate in your fiancé(e)’s home country.
Interview and Visa Application: Your fiancé(e) will be required to attend an interview at the U.S. embassy or consulate. They should provide required documents, including a medical examination, police certificates, and proof of a genuine relationship.
Visa Approval: If the interview goes well, your fiancé (e) will receive a K-1 visa, allowing them to enter the U.S. within a specified timeframe.
Entry and Marriage: Once your fiancé (e) arrives in the U.S., you have 90 days to get married. After the marriage, your spouse will apply for adjustment of status to become a lawful permanent resident and receive a Green Card..
Tips for a Successful Fiancée Visa Application
Gather Strong Evidence: Compile substantial evidence of your genuine relationship, such as photos, correspondence, and proof of visits.
Timely Filing: Ensure your petition and visa application is filed accurately and within the specified timeframes.
Prepare for the Interview: Thoroughly prepare your fiancé(e) for the embassy or consulate interview. They should be ready to answer questions about your relationship.
Maintain Communication: Keep regular communication with your fiancé(e) throughout the process to offer support and reassurance.
Reunite with your Loved ones using the fiancée visa path! Remember that the key to success lies in diligence, communication, and adhering to the legal requirements. Love truly knows no boundaries, and a fiancée visa can be the bridge to your happily ever after.
